These Terms & Conditions apply to purchases made through the Theta & Co website and form part of the agreement between you, the customer, and Viaarpe Limitless LTD, trading as Theta & Co(“Theta & Co”, “we”, “us” or “our”).
Please read these Terms carefully before placing an order.
By placing an order with Theta & Co, you confirm that you have read and agree to these Terms & Conditions.
1. About Theta & Co
Theta & Co is a fine jewellery brand offering jewellery including ready-to-order, made-to-order, bespoke and personalised pieces.

2. Our Jewellery
Our jewellery may feature natural gemstones, lab-grown gemstones, lab-grown diamonds and precious metals.
The exact materials used for each item will be stated in the relevant product description wherever applicable.
Because natural gemstones are created by nature, variations in colour, tone, inclusions, transparency, pattern and other characteristics are normal and form part of the individual character of each stone.
Images on our website are intended to represent our jewellery as accurately as reasonably possible. However, colours may appear differently depending on lighting, photography and screen settings.
Where jewellery is handmade or made to order, very small variations may occur between pieces.
3. Orders
Orders are subject to acceptance and availability.
After an order is placed, you will receive an order confirmation using the contact information provided at checkout.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
a product or gemstone is unavailable;
an incorrect price has been displayed;
payment has not been authorised;
we cannot reasonably fulfil the requested specification; or
we suspect fraudulent or unlawful activity.
If we cancel an order after payment has been received, the relevant amount will be refunded.
4. Made-to-Order Jewellery
Unless otherwise stated, many Theta & Co pieces are produced especially for the customer after an order is placed.
Our estimated production time is approximately two weeks.
This production period does not include shipping time.
Production times are estimates rather than guaranteed completion dates unless Theta & Co has expressly agreed a specific deadline with you in writing.
Production may occasionally take longer due to factors such as gemstone sourcing, specialist setting, engraving, sizing, quality control or circumstances outside our reasonable control.
Where we become aware of a material delay, we will contact you as soon as reasonably possible.
5. Bespoke and Personalised Jewellery
Bespoke or personalised jewellery includes pieces created, altered or manufactured according to a customer’s individual specifications.
This may include, for example:
custom designs;
personalised engraving;
individually selected gemstones;
unusual or customer-requested stone combinations;
specially requested metal specifications;
jewellery manufactured to a particular design supplied or approved by the customer; and
other significant customisation requested by the customer.
Once a bespoke design or specification has been approved and production has started, changes may not be possible.
Any requested changes after approval may be subject to additional charges and may affect the estimated completion date.
Customers are responsible for carefully checking names, dates, spelling, measurements, stone selections and other personalised details before approving an order.
6. Ring Sizes
Customers are responsible for selecting the correct ring size when placing an order.
If a customer has selected an incorrect ring size, Theta & Co may be able to resize the ring, depending on the design and construction of the piece. Additional resizing charges may apply.
Where resizing is requested due to an incorrect size selected by the customer, the customer will be responsible for the cost of sending the ring to Theta & Co and for the cost of return delivery once the resizing work has been completed.
Certain designs, settings or eternity-style rings may not be safely resizable. Where you are unsure of your size, please contact Theta & Co before placing your order.
This does not affect your statutory rights where a ring is faulty, incorrect or not supplied in accordance with your order.
7. Prices and Payment
All prices are displayed in GBP (£).
Full payment, or any deposit expressly agreed by Theta & Co, must be received before production begins.
Where a third-party payment provider or instalment service is offered, that provider’s own terms, eligibility requirements and privacy policies will also apply.
Delivery charges, where applicable, will be shown at checkout before payment is completed.
8. Production and Delivery
Our standard estimated production time for made-to-order jewellery is:
Approximately 2 weeks from order confirmation, plus shipping time.
Once production is complete, the order will be dispatched using the delivery method applicable to the order.
Estimated delivery times shown on our website or provided by a courier are estimates and may be affected by circumstances outside Theta & Co’s control.
Customers will receive tracking information where tracked delivery is available.
If you require jewellery for a particular event, wedding, anniversary or other fixed date, please contact us before placing your order. We cannot guarantee a specific delivery date unless it has been expressly confirmed by Theta & Co in writing.
9. Delivery Address
Customers are responsible for providing a complete and accurate delivery address.
Please contact us immediately if you notice an error.
Once an order has been dispatched, we may not be able to change the delivery address.
For security reasons, additional verification may be required for high-value orders.
10. International Orders
International customers may be responsible for customs duties, import taxes, handling fees or other charges imposed by the destination country.
Unless expressly stated otherwise, these charges are not included in the purchase price or delivery charge and are the responsibility of the customer.
Customs clearance may also affect delivery times.
11. Cancellation and Returns
Your cancellation and return rights depend on whether your jewellery is a standard item or has been made or personalised specifically for you.
Standard, non-personalised items
Where applicable under UK consumer law, customers purchasing eligible standard goods online may have the right to notify us of cancellation within 14 days after receiving the goods.

Bespoke or personalised items
Engraved, bespoke and personalised jewellery
Jewellery that has been engraved, made to the customer’s specifications or otherwise clearly personalised cannot normally be returned or cancelled simply because the customer changes their mind.
This includes rings personalised with names, initials, dates, messages, symbols or other engraving specifically requested by the customer.
Customers are responsible for checking all engraving details, spelling, dates, symbols and other personalised information before submitting or approving their order.
Once engraving or production of a personalised item has commenced, changes may not be possible and additional charges may apply.
This does not affect your statutory rights where an item is faulty, not as described or otherwise fails to comply with applicable consumer law.
12. Faulty or Incorrect Items
Nothing in these Terms limits your statutory consumer rights.
If you believe your jewellery is faulty, damaged upon arrival, incorrect or not as described, please contact us at thetaandco@outlook.com as soon as reasonably possible and provide your order details and photographs where appropriate.
We will assess the issue and provide the appropriate remedy in accordance with applicable UK consumer law.
13. Natural Gemstones
Natural gemstones may include characteristics such as inclusions, colour zoning and natural variation.
These characteristics are not automatically defects.
Where a gemstone has been subject to a treatment or enhancement that we are required to disclose, we will endeavour to include that information in the product description, accompanying documentation or other relevant sale information.
Gemstone weights and dimensions may be approximate where indicated.
14. Jewellery Care
Fine jewellery requires appropriate care.
Exposure to chemicals, cosmetics, perfume, chlorine, impact, abrasion, improper storage or unsuitable cleaning methods may damage gemstones or metals.
Normal wear and tear, accidental damage and damage caused by improper use or care are not manufacturing defects.
15. Repairs and Alterations by Third Parties
Theta & Co cannot accept responsibility for damage caused by repairs, resizing, setting work, polishing or alterations carried out by third parties after delivery.
16. Intellectual Property
All Theta & Co branding, photography, written content, graphics, logos and original jewellery designs appearing on our website remain the intellectual property of their respective owner and may not be copied, reproduced or used commercially without permission.
17. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Theta & Co will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from purchases made primarily for commercial purposes, to the extent permitted by law.
18. Changes to These Terms
We may update these Terms from time to time.
The Terms applicable to your purchase will normally be those made available to you when your order was placed.
19. Governing Law
These Terms are governed by the laws applicable in England and Wales, subject to any mandatory consumer rights available to customers in other applicable jurisdictions.
